DECISION AND CERTIFICATIONS OF REPRESENTATIVE
The National Labor Relations Board has considered objections to elections held
October 23, 2014, and the hearing officer's report recommending disposition of them. The
election was conducted pursuant to a Stipulated Election Agreement. The tally of ballots
in Case 31-RC-136697 shows 40 ballots cast for SEIU 121RN, and 19 ballots cast against
the participating labor organization. There were 6 challenged ballots, an insufficient
number to affect the results. The tally of ballots in Case 31-RC-136701 shows 113 ballots
cast for SEIU UHW-W, and 49 ballots cast against the participating labor organization.
There were 10 challenged ballots, an insufficient number to affect the results.
On August 4, 2015, the Employer requested to withdraw its June 2, 2015
Exceptions to the Hearing Officer's Report on Objections. That request is granted.
Accordingly, the Board adopts the hearing officer's findings and recommendations, and
finds that certifications of representative should be issued.
CERTIFICATION OF REPRESENTATIVE
IT IS CERTIFIED that a majority of the valid ballots have been cast for SEIU Local
121RN and that it is the exclusive collective-bargaining representative of the employees in
the following appropriate unit:
Included: All full-time, regular part-time and per diem registered nurses
and registered nurse advance skills employed by the Employer at its facility
located at 550 N. Monterey Ave. Ontario, CA.
Excluded: All office clerical employees, service and maintenance
employees, technical employees, physicians, guards, managers,
confidential employees, and supervisors as defined in the Act, as
amended.
CERTIFICATION OF REPRESENTATIVE
IT IS CERTIFIED that a majority of the valid ballots have been cast for SEIU UHW-
W and that it is the exclusive collective-bargaining representative of the employees in the
following appropriate unit:
Included: All full-time, regular part-time, and per diem employees
employed by the Employer at its facility located at 550 N. Monterey Ave.
Ontario, CA. in the following classifications: Certified Nursing Assistant,
Cook, Environmental Services Aide, Food Services Aide Handler, LPN-
LVN, Materials Management Clerk, Medical Technologist, Monitor
Technician, Phlebotomist, Radiology Technologist, Respiratory Therapist,
and Unit Secretary/ Unit Clerk.
Excluded: All other employees, HIM Clerks, MR Clerks, Admitting Clerks,
CLC, Social Workers, COTA’s, RNs, Physicians, Dos, DOPs, DPMs,
Radiologists, Pharmacy Techs, PTs, PTAs, Registered Dieticians, and all
other Classifications including but not limited to guards, managers,
confidential employees, and supervisors as defined in the Act, as
amended.
