R-1340, R-1341, and R-1342 CERTIFICATION OF REPRESENTATIVES December 27, 1939 On July 31 , 1939, the National Labor Relations Board, herein called the Board , issued its Decision and Direction of Election in the above -entitled proceeding .' Pursuant to the Direction of Elec- tion, an election by secret ballot was conducted between September 3, 1939, and November 27, 1939, under the direction and supervision of the Regional Director for the Fifteenth Region ( New Orleans, Louisiana ). On December 4, 1939 , the Regional Director , acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, issued and duly served upon the parties his Election Report. No Objections to the conduct of the ballot or the Election Report have been filed by any of the parties. The Regional Director reported the following results of the balloting : Total on eligibility list------------------------------------ 37 Total ballots cast----------------------------------------- 33 Total ballots challenged----------------------------------- 24 Total blank ballots--------------------------------------- 0 Total void ballots---------------------------------------- 0 Total valid votes cast------------------------------------- 33 Votes cast for Commercial Telegraphers' Union, Marine Di- vision, A. F. of L---------------------------------------- 5 Votes cast for American Communications Association (ACA), C. I. 0------------------------------------------------ 24 Votes cast for neither organization------------------------- 0 By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Rela- tions Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and '13 N. L. R. B. 1336. 2 The four challenged ballots, since they cannot affect the majority result , were not passed on and remain unopened and uncounted , but for the purpose of this report,have been treated as valid ballots. 18 N. I. 0., has been selected by a majority of the radio operators employed in actual service on board vessels operated by Tampa Inter-Ocean Steamship Co., Lykes Brothers Steamship Co., Inc., and Lykes Brothers Coastwise Line, Inc., or who have a "stand-by" status, as their representative for the purposes of collective bargaining, and that pursuant to Section 9 (a) of the National Labor Relations Act, American Communications Association, C. I. 0., is the exclusive bargaining representative of all such employees for the purposes of collective bargaining in respect to rates of pay, wages, hours of employment, and other conditions of employment.
