Pursuant to the Direction of Election, an election by secret ballot was conducted on November 28, 1939, under the direc- tion and supervision of the Regional Director for the Fifth Region (Baltimore, Maryland). On November 30, 1939, the Regional Direc- tor, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, issued and duly served upon the parties his Election Report. No objections to the conduct of the ballot or the Election Report have been filed by' any of the parties. As to the balloting and its results, the Regional Director reported as follows : Total number of eligible voters---- ------------------------ 310 Total number of ballots cast------------------------------- 297 Total number of votes for Textile Workers Union of America (C. I. 0.) -------------------------------------------- - 208 Total number of votes against Textile Workers Union of America ( C. I. 0.) -------------------------------------- 85 Total number of blank ballots ----------------------------- 1 Total number of void ballots------------ ------------------- 0 Total number of challenged ballots----------- ------------- 3 Since the number of challenged ballots cannot affect the result of the election, we find it unnecessary to pass upon the challenges. By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Relations Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, National Labor Relations Board Rules and Regulations- Series 2, 117 N. B., No. 64. 472 TABARDREY MANUFACTURING COMPANY 473 IT IS HEREBY CERTIFIED that Textile Workers Union of America has been designated and selected by a majority of all hourly and piece-rate production and maintenance employees of Tabardrey Manufacturing Company, Haw River, North Carolina, excluding clerical and supervisory employees and watchmen, as their repre- sentative for the purposes of collective bargaining, and that pur- suant to the provisions of Section 9 (a) of the National Labor Rela- tions Act, Textile Workers Union of America is the exclusive repre- sentative of all such employees for the purposes of collective bar- gaining in respect to rates of pay, wages, hours of employment, and other conditions of employment.
