Case No. R-2713 SUPPLEMENTAL DECISION AND CERTIFICATION OF REPRESENTATIVES January 31, 1942 On September 5, 1941 , the National Labor Relations Board, herein called the Board, issued a Decision and Direction of Election;' on October 25 , 1941, a Supplemental Decision and Second Direction of Election ; 2 and on November 29 , 1941 , a Supplemental Decision and Direction of Second Run-Off Election ,3 in the above -entitled proceed- ing. Pursuant to the Direction of Second Run-Off Election, a second run -off election by secret ballot was conducted on December 16, 1941, under the direction and supervision of the Regional Director for the Fourteenth Region ( St. Louis, Missouri ). On December 17, 1941 , the Director , acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, issued and duly served upon the parties an Election Report. B., No. 159. 898 SWIFT & COMPANY 899 On January 15, 1942, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, issued a Report on Objections stating in substance that the objections raised no substantial or material issues withrespect to the conduct of the election. We have considered the objections of the S. E. A. and the Regional Director's report thereon. We are of the opinion that the objections raise no substantial or material issues with respect to the conduct of the election. The objections are hereby overruled. CERTIFICATION OF REPRESENTATIVES By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Rela- tions Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, IT IS HEREBY CERTIFIED that Amalgamated Meat Cutters & Butcher Workmen of North America, A. F. of L., has been designated and selected by a majority of the production and maintenance employees of the National City plant and the fertilizing plant of Swift & Com- pany, National City, Illinois, excluding the superintendent, assistant superintendent, division superintendents, general foremen, assistant general foremen, foremen, assistant foremen, night superintendent, working foremen, doctor, timekeeper, head and assistant head of standards department, head and assistant head of the chemical lab- oratory, head and assistant head of receiving department, head and assistant head of fire hall, plant-protection employees, bell-pullers, restaurant administrator, fire marshal, chief of police, yardmaster, general office employees, superintendent's clerical office employees, mechanical clerical office employees, time office clerical employees, credit union clerical employees, standards office clerical employees, plant clerks, teamsters and chauffeurs, brickmasons, chemists, canteen employees, nurse, chef, assistant foremen to store department, plant matrons, all employees on the miscellaneous pay roll, dock checkers, scalers, and Mrs. Foley, as their representative for the purposes of collective bargaining, and that, pursuant to Section 9 (a) of the Act, Amalgamated Meat Cutters & Butcher Workmen of North America, A. F. of L., is the exclusive representative of all such employees for the purposes of collective bargaining in respect to rates of pa, wages, hours of employment, and other conditions of employment.'
