JOSEPH, MISSOURI Case No. R-208 SECOND AMENDMENT TO DIRECTION OF ELECTION Jwne 24, 1941 On October 17, 1940, the National Labor Relations Board, herein called the Board, issued a Decision and Direction of Election in the above-entitled proceeding.,, On November 12, 1940, the Board issued an Amendment to Direction of Election,2 postponing the election in- definitely because charges of unfair labor practices had been filed by Local No. 95, United Packinghouse Workers of America, Packing- house Workers Organizing Committee, affiliated with the Congress of Industrial Organizations, herein called- the P. W. O. C.3 On March 15, 1941, Swift & Company, herein called the Company, filed a Petition for Vacation of Order asking that the Amendment to Direction of Election be vacated and that an election be held promptly in' this pro- ceeding. On June 16, 1941, the P. W. O. C. withdrew its charges. Under the circumstances we shall proceed with the election. The Board hereby amends its Direction of Election, as amended, by striking therefrom the words "at such time as the Board shall hereafter direct" and substituting therefor the words "as early as possible, but not later than thirty- (30) days from the date of this Second Amendment to Direction of Election," by striking' therefrom the words "a pay-roll period which the Board shall in the future specify" and substituting therefor the words "the pay-roll' period im- n.ediately preceding-the date of this Second Amendment to Direction of Election," and by striking therefrom the words "and employees with plant seniority who were then or have since been temporarily laid off" and substituting therefor the words "or in the active military service or training of the United States, and employees with plant seniority who were then or have since been temporarily laid off." 1 27 N L R.
