SHARP, DOING BUSINESS AS SUREBEST BAKERS and UNITED BAKERY WORKERS LOCAL INDUSTRIAL UNION No. 1145 (CIO) Case No. B-3412 SECOND DIRECTION OF ELECTION 11 June ill 1942 On February 10, 1942, the National Labor Relations Board, herein called the Board, issued its Decision and Direction of Election in the above-entitled proceeding., Pursuant to the Direction of Election, an election by secret ballot was conducted on March 6, 1942, under the direction and supervision of,the Regional Director for the Sixteenth Region (Fort Worth, Texas), and on March 11, 1942, the said Regional Director issued an Election Report, copies of which were duly served upon the parties. Thereafter, United Bakery Workers Local Indus- trial Union No. 1145 (CIO), herein called the United, filed objections to the Regional Director's recommendations as to the disposition of certain challenged ballots. On April 25, 1942, the Board issued a 'Supplemental Decision and Direction 2 ordering that the challenged ballots be opened and counted, and on April 27, 1942, the Regional Di- rector opened and counted the challenged ballots. On April 29, 1942,. the Regional Director issued a Supplemental Election Report, copies of which were duly served upon the parties. B 863 41 N L R B, No 162. 463892-42-vol 41-58 -- 913 914 DECISIONS OF NATIONAL LABOR RELATIONS BOARD On May 21, 1942, United Bakery Workers Local Industrial Union No. 1145, affiliated with the Congress of Industrial Organizations, filed a request for a run-off election. Although neither of the competing labor organizations received a majority of the votes cast, the-results of the election, show that a substantial majority of employees voting in the election desire to bargain'collectively with the Company. Ac- cordingly, we shall direct a run-off election among those employees eligible to vote under our Decision and Direction of Election of Febru- dry 10, 1942; to decide whether they desire to be represented by United Bakery Workers Local Industrial'Union No. 1145, affiliated with the Congress of Industrial Organizations. or by Bakery and Confectionery Workers, International Union of America, Local No. 225, affiliated with-the American. Federation of Labor, for the purposes of collective bargaining. SECOND DIRECTION OF ELECTION By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Relations Act, and pursuant to Article III, Sections 8 and 9, of National Labor Rela- tions Board Rules and Regulations-Series 2, as amended, it is hereby DLRECTED that, as part of the investigation to ascertain representa- tives for the purposes of collective bargaining with S. R. Sharp, doing business as Surebest Bakers, El Paso, Texas, an election by secret ballot shall be conducted as soon as possible, but not later than thirty (30) days from the date of this Second Direction of Election, under the di- rection and supervision of the Regional Director for the Sixteenth Region, acting in this matter as agent for the National Labor Relations Board, and subject to Article III, Section 9, of said Rules and Regu- lations, among the employees described in the Decision and Direction of Election issued on February 10, 1942, but excluding those who have since quit or been discharged for cause, to determine whether they de- sire to be represented by United Bakery Workers Local Industrial Union No. 1145, affiliated with the Congress of Industrial Organiza- tions, or by Bakery and Confectionery Workers, International Union of America, Local No. 225, affiliated with the American Federation of Labor, for the purposes of collective bargaining.
