Case No. R-2490 SUPPLEMENTAL DECISION AND ORDER July 25, 1941 On May 27, 1941, the National Labor Relations Board, herein called the Board, issued a Decision and Direction of Election in -the above- entitled proceeding.' Pursuant to the Direction of Election, an elec- tion by secret ballot was conducted on June 20, 1941, by the Regional Director for the Thirteenth Region (Chicago, Illinois). On June 21, 1941, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, issued and duly served upon the parties an Election Report. No objections to the conduct of the ballot or to the Election Report have been filed by any of the parties. As to the balloting and its results, the Regional Director reported as follows : Total number on eligibility list------------------------------- 52 Total ballots cast------------------------------------------- 51 Total ballots challenged------------------------------------- 12 a. Challenged ballots determined eligible----------------- 0 b. Challenged ballots determined not eligible-------------- 0 Total blank ballots------------------------------------------ 0 Total number of void ballots-------------------------------- 0 Total number of ballots cast for the union------------------- 14 Total number of ballots cast against the union--------------- 25 The Regional Director recommended that the challenges to the bal- lots of five employees be sustained since it appears that they are among those employees excluded from the unit in the Board's De- cision and Direction of Election. The Regional Director made no recommendation as to the remaining seven challenged ballots, since they could not affect the outcome of the election. The results of the election show that no collective bargaining repre- sentative has been selected by a majorityof the employees of the Com- pany in the unit heretofore found to be appropriate for collective bargaining. We shall therefore dismiss the petition for investigation and certification of representatives of employees of the Company. ORDER By virtue of Section 9 (c) of the National Labor Relations Act, 49 Stat. 449, and pursuant , to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations- Series 2, as amended, IT Is HEREBY ORDERED that the petition for investigation and certi- fication of representatives of employees of Supreme Liberty Life Insurance Company, Chicago, Illinois, filed by American Federation of Industrial and Ordinary Insurance Agents, No. 20817, A.
