UNION, LOCAL No. 18, INTERNATIONAL UNION OF MINE, MILL & SMELTER WORKERS, AFFILIATED WITH THE CONGRESS OF INDUSTRIAL ORGANIZATIONS Case No. R-2954 CERTIFICATION OF REPRESENTATIVES November 28, 1941 On October 13, 1941, the National Labor Relations Board issued its Decision and Direction of Election 1 in the above-entitled proceed- ing. Pursuant to the Direction of Election, an election by secret ballot was conducted on October 29, 1941, under the direction and supervision of the Regional Director for the Nineteenth Region '(Seattle, Washington). On October 31, 1941, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Rela- tions Board Rules and Regulations-Series 2, as amended, issued an Election Report, copies of which were duly served upon the parties. No objections to the conduct of the ballot or to the Election Report have been filed by any of -the parties. As to the balloting and its results, the Regional Director reported as follows : Total on eligibility list -------------------------------------- 315 Votes cast for Kellogg M. & S Union, Local No. 18, C. I. O--- 186 Votes cast against Kellogg M. & S. Union, Local No. 18, C. I. 0------------------------- ------------- 105 Total ballots challenged------------------------------------- 1 Total valid votes cast--------------------------------------- 291 Total on eligibility list not voting--------------------------- 23 Since it could have no possible effect on the outcome of the, election, the Regional Director made no ruling on the challenged vote. By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Re- lations Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, 136 N. L. R. B. 107 37 N. L. R. B., No. 11. 42 SULLIVAN MINING COMPANY 43; IT IS HEREBY CERTIFIED that Kellogg M. and S. Union, Local No. 18, International Union of Mine, Mill & Smelter Workers, affiliated with the Congress of Industrial Organizations, has been designated and selected by a majority of all employees of the electrolytic zinc plant of Sullivan Mining Company, Kellogg, Idaho, including those classi- fied as production,and maintenance men, watchmen, gatemen, sample-- men, boilerhouse men, generator room men, and working shift bosses, but excluding employees classified as clerical men, technicians, fore- men; and all other executives, as their representative for the purposes of collective bargaining, and that pursuant to the provisions of Sec- tion 9 (a) of the National Labor Relations Act, Kellogg M. and S. Union, Local No. 18, International Union of Mine, Mill & Smelter Workers, affiliated with the Congress of Industrial Organizations, is the exclusive representative of all such employees for the purposes, of collective bargaining with respect to rates of pay, wages, hours. of employment, and other conditions of employment.
