Case No. R-2294 SUPPLEMENTAL DECISION AND CERTIFICATION OF REPRESENTATIVES Jvme 24, 1941 On May 12, 1941 , the National Labor Relations Board issued a Decision and Direction of Election in the above -entitled proceeding Pursuant to the Direction , an election by secret ballot was conducted on June 6, 1941 , under the direction and supervision of the Regional Director for the Thirteenth Region (Chicago, Illinois ) among the pattern makers and apprentice pattern makers of Sullivan Machinery Company, herein called the Company, at its Michigan City, Indiana, plant, excluding the foreman pattern maker . On June 9, 1941, the Regional Director , acting pursuant to Article III, Section 9, of Na- tional Labor Relations Board Rules and Regulations-Series 2, as amended, issued and duly served upon the parties his Election Report. No Objections to the conduct of the ballot or the Election Report have been filed by any of the parties. The pattern makers and apprentice pattern makers of the, Com- pany at' .its Michigan City, Indiana, plant, excluding, the foreman pattern maker; constitute a ,unit appropriate for the purposes of col- lective bargaining, within the meaning-of Section 9 (b) of the National Labor Relations .Act.: . 1 ;1 ' ' I ' 2. 'Pattern Makers' League of North America South Bend Asso- ciation has been designated and selected by a majority of the em- ployees, in the unit described in paragraph 1 above; as ' their representative for the purposes of collective bargaining, 'and is the exclusive representative of all the employees in said unit, within 'the meaning of Section 9 (a) of the National Labor Relations, Act. 3.. All employees of the Company at its Michigan City, Indiana, plant, including' stock, room clerks, but excluding pattern makers and apprentice pattern makers, excluding office workers and watch- men, who include August Schalton, Arthur Schaeffer, Sherman Covey, and James Livinghouse, and ex,""luding superintendents,' assistant superintendents, foremen, instructors, sub-foremen, timekeepers, pro- duction control employees, shipping and receiving clerks, and the seven employees in the contract drill department, constitute a unit appropriate for the purposes of collective bargaining, within the meaning of Section 9 (b) of the National Labor Relations Act. 4. International Union, United Automobile Workers of America, Local 766, C. I. 0., has been designated and selected by a majority of the employees in the unit described in paragraph 3 above, as their representative for the purposes of collective bargaining, and is the exclusive representative of all the employees in said unit, within the meaning of Section 9 (a) of the National Labor Relations Act.- CERTIFICATION OF REPRESENTATIVES By virtue of and pursuant to the power vested in .the National Labor Relations Board by Section 9 (c) of the National Labor Rela- tions Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, . IT IS HERESY CERTIFIED that Pattern Makers' League of North America; South Bend Association, has been designated and selected by a majority of the pattern makers and apprentice pattern makers of Sullivan Machinery Company at its Michigan City, Indiana, plant, excluding the foremen pattern maker, as their representative for the purposes of collective bargaining, and that, pursuant to Section 9 (a) of the National Labor Relations Act, Pattern Makers' League of North America, South Bend Association, is the exclusive repre- 1118 DECISIONS OF NATIONAL LABOR RELATIONS BOARD sentative of all such employees for the purpose of collective bar- gaining in respect to rates of pay, wages, hours of employment, and other conditions of employment. IT IS HEREBY CERTIFIED that International Union, United Automobile Workers of America, Local 766, C. I. 0., has been designated and selected by a majority of all employees of Sullivan Machinery Com- pany at its Michigan City, Indiana, plant, including stock room clerks, but excluding pattern makers and apprentice pattern makers, excluding office workers and watchmen, who include August Schalton, Arthur- Schaeffer, Sherman Covey, and James Livinghouse, and ex- cluding superintendents, assistant superintendents, foremen, in- structors, sub-foremen, timekeepers, production control employees, shipping and receiving clerks, and the seven employees in the contract drill department, as their representative for the purposes of collective bargaining, and that, pursuant to Section 9 (a) 'of the National Labor Relations Act, International Union, United Automobile Workers of America, Local 766, C.
