grounds that the recess appointments to the Board of Members Block and Griffin by the President were not
properly constituted. For the reasons set forth in Center for Social Change, Inc., 358 NLRB No. 24 (2012),
we reject this argument. Member Flynn is recused and took no part in the consideration of this case.
