Cases 12-CC- 513-1 and 12-CC-513-2 June 9, 1971 SUPPLEMENTAL DECISION AND ORDER review and set aside the Board's Order on the ground that the finding of the Board that the picketing was protected primary activity was not supported by sub- stantial evidence on the record as a whole and was legally erroneous.2 It therefore vacated the order of the Board dismissing the complaint and remanded the pro- ceeding to the Board with directions to enter the order recommended by the Trial Examiner. The Board, having accepted the court's remand, hereby adopts the recommendations of the Trial Exam- iner. On June 30, 1969, the National Labor Relations Board issued its decision and Order in the above-enti- tled proceeding,' finding, contrary to the Trial Exam- iner, that Respondent United Steelworkers of America and its Local 6991 did not as alleged violate Section 8(b)(4)(B) of the Act. Accordingly, the Board dis- missed the complaint. Subsequently, Auburndale Freezer Corporation and Minute Maid Company filed with the United States Court of Appeals for the Fifth Circuit a petition to review and set aside the Board's order. Thereafter, on December 3, 1970, the court handed down its decision in which it granted the petition to 1 177 NLRB No 108 ORDER Pursuant to Section 10(c) of the National Labor Re- lations Act, as amended, and the court decision, the National Labor Relations Board adopts as its Order the Recommended Order of the Trial Examiner and hereby orders that Respondents, United Steelworkers of America and its Local 6991, their officers, agents, and representatives, shall take the action set forth in the Trial Examiner's Recommended Order.
