KATZ, Administrative Patent Judge. 2 Following the Decision on Motions (Paper 206), this interference proceeded to a priority phase (Paper 207). Before the stipulated time for filing priority motions, the parties indicate they have settled (Paper 210) and Stauss filed a request for adverse judgment (Paper 211). It is ORDERED that claims 1-4 of Stauss patent 7,326,767 and claims 1-8 of Stauss patent 8,529,904 are CANCELED. 35 U.S.C. § 135(a).1 Furthermore, in light of our decision to grant-in-part Stauss Motion 1, for unpatentability under 35 U.S.C. § 135(b), claim 73 of Sugiyama application 12/181,938 is FINALLY REFUSED. (See Decision on Motions, Paper 206, at 19:17-20:18.) It is further ORDERED that a party seeking judicial review timely serve notice on the Director of the United States Patent and Trademark Office. 37 C.F.R. §§ 90.1 and 104.2. See also Bd. R. 8(b). Attention is directed to Biogen Idec MA, Inc., v. Japanese Foundation for Cancer Research, No. 2014-1525, slip op. at 5-18 (Fed. Cir. May 7, 2015) (determining that pre-AIA § 146 review was eliminated for interference proceedings declared after September 15, 2012.) It is further ORDERED that a copy of this judgment be entered into the administrative records of Stauss patents 7,326,767 and 8,529,904 and Sugiyama application 12/181,938. 1 Patent interferences continue under the relevant statutes in effect on 15 March 2013, Pub.
