1 Although Member McFerran joins her colleagues in denying the Employer’s Request for
Review, she does not agree, for the reasons stated in her dissent in Manor Care of Yeadon, 368
NLRB No. 28 (2019), that PCC Structurals, Inc., 365 NLRB No. 160 (2017), properly reinstated
Park Manor Care Center, 305 NLRB 872 (1991), which the Regional Director applied in
determining the appropriateness of the petitioned-for unit. Nevertheless, Member McFerran
finds that the unit is appropriate under either Park Manor or Specialty Healthcare &
Rehabilitation Center of Mobile, 357 NLRB 934 (2011), enfd. sub nom. Kindred Nursing
Centers East, LLC v. NLRB, 727 F.3d 552 (6th Cir. 2013), which PCC Structurals overruled.
