Southern California Gas Co.Download PDFNational Labor Relations Board - Board DecisionsMar 8, 193911 N.L.R.B. 1032 (N.L.R.B. 1939) Copy Citation In the Matter of SOUTHERN CALIFORNIA GAS COMPANY and UTILITY WORKERS ORGANIZING COMMITTEE , LOCAL No. 132 Case No. R-861 CERTIFICATION OF REPRESENTATIVES March 8, 1939 On January 14, 1939, the National Labor Relations Board, herein called the Board, issued a Decision and Direction of Election in the above-entitled proceeding 1 and on January 28, 1939, issued an Amendment to this Direction of Election.2 The Direction of Election as amended provided that an election by secret ballot be conducted within thirty (30) days from the date of the Direction among pro- duction employees in the Central Division of Southern California Gas Company, Los Angeles, California, whose names appeared on the pay roll of the Company next preceding the date of the Direction and who were included in the following classifications : auxiliary engine- man, blacksmith, bricklayer, carpenter, chainman, chart collector, receiving clerk, shipping clerk, gas dispatcher, order dispatcher, elec- trician, plant engineer, fireman, fitter, fitter-welder, gas maker, helper, field meter inspector, meter inspector, janitor (except office janitors), laborer, regular laborer, machine operator, machinist, mechanic #1, mechanic #2, oiler, crane operator, station operator, terminal opera- tor, painter, meter clock repairman, repairman plant #1, repairman plant #2, serviceman #1, serviceman #2, industrial serviceman, station attendant, storeroom attendant, storeroom keeper, field meter tester, tinsmith, and truck driver ; and including temporary em- ployees who had been employed by the Company for 6 weeks within the 15-week period preceding the date of the Direction of Election, to determine whether or not they desired to be represented by Utility Workers Organizing Committee, Local No. 132, affiliated with the Committee for Industrial Organization, for the purposes of collec- tive bargaining. Pursuant to the Direction of Election, as amended, an election by secret ballot was conducted on February 7 and 8, 1939, under the direction and supervision of the Regional Director for the Twenty- first Region. On February 13, 1939, the Regional Director, acting pur- suant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 1, as amended, issued and duly served upon the parties an Intermediate Report upon the secret ballot. On February 20, 1939, an amendment to this Intermediate Report was served upon all parties. No objections or exceptions to the Inter- mediate Report or the amendment thereto were filed by any of the parties. As to the balloting and its results, the Regional Director reported as follows : Total number eligible______________________________________ 1334 Total number of ballots counted____________________________ 1230 Total number of votes for Utility Workers Organizing Com- mittee, Local No. 132_____________; _________-_____________ 779 Total number of votes against Utility Workers Organizing Committee, Local No. 132________________--------------------------------- 420 Total number of blank ballots______________________________ 2 Total number of void ballots_______________________________ 3 Total number of challenged votes___________________________ 26 By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Rela- tions Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 1, as amended, IT IS HEREBY CERTIFIED that Utility Workers Organizing Commit- tee, Local No. 132, affiliated with the Committee for Industrial Organ- ization, has been selected by a majority of the production employees in the Central Division of Southern California Gas Company, in- cluded in the following classifications : auxiliary engineman, black- smith, bricklayer, carpenter, chainman, chart collector, receiving clerk, shipping clerk, gas dispatcher, order dispatcher, electrician, plant engineer, fireman, fitter, fitter-welder, gas maker, helper, field meter inspector, meter inspector, janitor (except office janitors), laborer, regular laborer, machine operator, machinist, mechanic #1, mechanic #2, oiler, crane operator, station operator, terminal opera- tor, painter, meter clock repairman, repairman plant #1, repairman plant #2, serviceman #1, serviceman # 2, industrial serviceman, station attendant, storeroom attendant, storeroom keeper, field meter tester, tinsmith, and truck driver, including temporary employees, as their representative for the purposes of collective bargaining, and that pursuant to Section 9 (a) of the Act, Utility Workers Organizing Committee, Local No. 132, affiliated with the Committee for Indus- trial Organization, is the exclusive representative of all such em- ployees for the purposes of collective bargaining in respect to wages, rates of pay, hours of employment, and other conditions of em- ployment.
