Bornong of the National Labor Relations Board issued his Report and Recommendation to the Board on Objections, in which he recommended overruling all of the Petitioner’s objections to the mail ballot elections held in these proceedings and the issuance of a Certification of Results of Election. The elections, which were held starting on May 6, 2011, were conducted pursuant to Stipulated Election Agreements. The tally of ballots in Case 18-RC- 17751 shows 22 ballots cast for and 23 ballots cast against the Petitioner, with no challenged ballots. The tally of ballots in Case 18-RC-17752 shows 1 vote cast for and 2 ballots cast against the Petitioner, with 1 challenged ballot, an insufficient number to affect the results. 2 The Employer filed timely exceptions to the Hearing Officer’s Report and Recommendation. On November 16, 2011, the Employer filed a Motion to withdraw its Exceptions to the Hearing Officer’s Report and Recommendation. The Employer’s Motion to withdraw its Exceptions is hereby granted. Accordingly, as there are no exceptions pending before the Board and the time allowed for such filing having expired, the Board adopts the Hearing Officer’s findings and recommendation. CERTIFICATION OF RESULTS OF ELECTIONS IT IS CERTIFIED that a majority of the valid ballots have not been cast for AFSCME Council 5, and it is not the exclusive collective-bargaining representative of these bargaining units’ employees.
