Board, issued a Decision and Direction of Election in the above-entitled proceedings.' Pursuant to the Direction of Election, an election by secret ballot was conducted on October 9, 1941, under the direction and supervision of the Regional Director for the Seventh Region (Detroit, Michigan). On October 23, 1941, the Acting Regional Director, acting pursuant to'Article_III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, issued and duly served upon the parties an Election Report. On December 27, 1941, the Board issued a Supplemental Decision and Direction,2 directing that the Regional Director (1) open and count the ballots of Charles Happ, Frank Olinn, and George Plotts; (2) conduct a further investigation as to the eligibility of Norman Krietsch if the counting of his ballot could affect the results of the election; and (3) thereafter prepare a Supplemental Election Report embodying his findings and recommendations as to the results of the balloting. Since the ballot of Norman Krietsch could not, if valid, affect the result of the election, it is unnecessary to consider and determine the eligibility of the voter who cast it. By virtue of ' and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Relations Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations- Series 2, as amended, IT IS HEREBY CERTIFIED that The Associated Chemical Workers of Michigan has been designated and selected by a majority of the hourly paid production and maintenance employees of Solvay Proc- ess Company, Detroit, Michigan, excluding foremen and other super- visory employees and office and plant-protection employees, as their representative for the purposes of collective bargaining, and that, pursuant to Section 9 (a) of the National Labor Relations Act, The Associated Chemical Workers of Michigan is the exclusive repre- sentative of all such employees for the purpose of collective bar- gaining in respect to rates of pay, wages, hours of employment, and other conditions of employment. - Copy with citationCopy as parenthetical citation
