Case No. B-3197 CERTIFICATION OF REPRESENTATIVES February 9,1912 On November 29, 1941 , the National Labor Relations Board issued its Decision and Direction of Election in the above -entitled proceed- ing.' Pursuant to the Direction of Election , an election by secret ballot was conducted on December 18, 1941 , under the direction and supervision of the Regional Director for the Tenth Region (Atlanta, Georgia ). On December 29, 1941 , the Regional Director , acting pur- suant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, issued an Election Re- port, copies of which were duly served upon the parties . No objections to the conduct of the ballot or to the Election Report were filed by any of the parties. R B 134 The Board found the collective bargaining unit to be "all em- ployees of the concrete department of the city furnaces of the Company, excluding super- visory and clerical employees " On January 26, 1942, the parties filed a stipulation with the Board in which they requested that the appropriate unit be made to read "all employees of the concrete plant located near the city furnaces of the Company, excluding supervisory and clerical employees " The requested unit is intended to cover the same employees as were included within the unit found by the Boaid The request of the parties is hereby granted. 38 N. B, No. 193. 1036 SLOSS-SHEFFIELD STEEL & IRON CO. 1037 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, IT IS HEREBY CERTIFIED that District 50, United Mine Workers of America, affiliated with the Congress of Industrial Organizations, has been designated and selected by a majority of all employees of the concrete plant located near the city furnaces of the Sloss-Sheffield Steel & Iron Co., Birmingham, Alabama, excluding supervisory and clerical employees, as their representative for the purposes of collective bar- gaining, and that, pursuant to the provisions of Section 9 (a) of the National Labor Relations Act, District 50, United Mine Workers of America, C. I. 0., is the exclusive representative of all such employees for the purposes of collective bargaining with respect to rates of pay, wages, hours of employment, and other conditions of employment.
