ORDER The Acting General Counsel’s and Charging Party’s Motions to Strike Respondent’s Answering Brief to Cross-Exceptions1 for failure to comply with the Board’s Rules and Regulations are denied. It is well-established that the Board will show leniency toward a pro se litigant’s efforts to comply with our procedural rules. A.P.S. Production/A Pimental Steel, 326 NLRB 1296, 1297 (1998). Although Respondent’s exceptions may not be in full compliance with the literal requirements of Section 102.46 of the Board’s Rules, the exceptions document sufficiently designates the Respondent’s points of disagreement with the judge’s decision. See Williams Services, Inc., 302 NLRB 492, fn. 1 (1991). Moreover, the Charging Party has not shown that it suffered any prejudice by the Respondent’s failure to serve the Charging Party. By direction of the Board: Dated, Washington, D.C., November 28, 2012. Farah Z. Qureshi Associate Executive Secretary 1 The Board has construed the Respondent’s “Answering Brief to Cross-Exceptions” as exceptions.
