Jan. 24, 2014) Copy Citation Indianapolis, IN UNITED STATES OF AMERICA BEFORE THE NATIONAL LABOR RELATIONS BOARD SHEEHY ENTERPRIZES, INC. and LABORERS' INTERNATIONAL UNION OF NORTH AMERICA, STATE OF INDIANA DISTRICT COUNCIL, A/W LABORERS' INTERNATIONAL UNION OF NORTH AMERICA Case: 25-CA-030583 SUPPLEMENTAL ORDER A controversy having arisen over the amounts of backpay due the discriminatees under the terms of the Orders issued by the National Labor Relations Board on January 30, 2009, and August 12, 2010, and enforced by the United States Court of Appeals for the Seventh Circuit, the Acting Regional Director for Region 25, on August 8, 2013, issued a Compliance Specification and Notice of Hearing. Pursuant thereto, a hearing was held before Administrative Law Judge Arthur J. Amchan. Thereafter, on December 12, 2013, the Administrative Law Judge Arthur J. Amchan issued his Supplemental Decision and, on the same date, the proceeding was transferred to and continued before the Board in Washington, D.C. The Administrative Law Judge determined the amounts of backpay due the discriminatees and recommended that the Respondent, Sheehy Enterprizes, Inc., Indianapolis, Indiana, its officers, agents, successors and assigns shall make whole the discriminatees and Union Trust Funds as set forth in the December 9, 2013 compliance specification. No statement of exceptions having been filed with the Board, and the time allowed for such filing having expired, 2 Pursuant to Section 10(c) of the National Labor Relations Act, as amended and Section 102.48 of the National Labor Relations Board Rules and Regulations, the Board adopts the findings and conclusions of the Administrative Law Judge as contained in his Supplemental Decision, and orders that the Respondent, Sheehy Enterprizes, Inc., its officers, agents, successors, and assigns, shall pay the amounts set forth in the recommended Order of the Administrative Law Judge.
