On April 24, 1942, the National Laboi Relations Board issued its
Decision and Direction of Election in the above-entitled proceeding'
Pursuant to the Direction of Election, an election by secret ballot
was conducted on May 8, 1942, under the direction and supervision
of the Acting Regional Director of the Tenth Region (Atlanta,
Georgia)' On June 23, 1942, the Board issued a Supplemental De-
cision and Direction, directing the Regional Director to open and
count 10 challenged ballots 2 On July 1, 1942, the Acti4ig Regional
Director, acting pursuant to Article III, Section 9, of National Labor
Relations Board Rules and Regulations-Series 2, as amended, issued
a Supplemental Report on Ordeied Election, copies of which were
duly served upon the parties
In his Supplemental Report on Ordeied Election, the Acting Re-
gional Director reported that on June 30, 1942, the 10 challenged
ballots were opened in the presence of duly authorized observers of
the Company and the Union. As to the final results of the balloting
in the election, after the counting of the challenged ballots ordered
to be opened by the Board, the Acting Regional Dilectoi ieported as
follows

By virtue of and puifuant to the power vested in the National Labor
Relations Board by Section 9 (c) of the National Labor Relations
Act, and pursuant to Article III, Sections 8 and 9, of National Laboi
Relations Board Rules and Regulations-Seiies 2, as amended,
IT IS HEREBY CERTIFIED that Distiict 50, United Mine Woikers of
America, Local Union 12308, has been designated and selected by a
majoiity of all production, maintenance, shipping, and receiving
employees at the Easley plant of Semet-Solvay Company, Ensley,
Alabama, excluding supervisory forces, office clerks on salary, and
technical employees, as their representative for the purposes of col-
lective bargaining, and that, pursuant to the provisions of Section
9 (a) of the Act, District 50, United Mine Workers of America, Local
Union 12308, is the exclusive iepresentative of all such employees for
the purposes of collective bargaining in respect to rates of pay, wages,
hoius of employment, and othei conditions of employment
