The Direction of Election provided that an election by secret ballot be conducted within thirty (30) days from the date of the Direction among the employees of the Seattle Post-Intelligencer De- partment of Hearst Publications, Inc., a corporation , employed on March 5, 1938 in the editorial , classified advertising, display adver- tising, promotion , circulation , and purchasing departments, the business office , and the outside telephone crew, but excluding Home Edition District Men Helpers-Seattle; District Man-Tacoma; Branchmen ; Branchmen'sHelpers ; Street Circulators-Seattle; Street Circulators-Portland ; Roadmen; the following assistants to the Cir- culation Manager, namely, Branch Manager, Canvasser Manager, and Country and Suburban Circulator; Traffic Clerks; Return Clerks ; Canvassers-City ; Canvassers-Outside City ; and Motor Route Drivers, and excluding any of the foregoing who have since quit or been discharged for cause, and excluding also all executives and department managers but including all other supervisors, to determine whether or not they desire to be represented by Seattle Newspaper Guild, Local No. 82, for the purposes of collective bar- gaining. The Direction provided also that a separate secret ballot be taken of Ruby Givan, Helen Hoover, and Ray Griffith with respect to whom charges of unfair labor practices had been filed, and their ballots be segregated pending the disposition of the issues raised by these charges. Pursuant to the Direction of Election, an election by secret ballot was conducted on December 13, 1938 under the direction and super- vision of the Regional Director for the Nineteenth Region ( Seattle, Washington). On December 22, 1938, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules. and Regulations-Series 1, as amended, issued and duly served upon the parties an Intermediate Report on the election. No objections or exceptions to the Intermediate Report have been filed by any of the parties. As to the balloting and its results, the Regional Director reported as follows : Total number of eligible voters---------------------------------- 197 Total number of ballots cast------------------------------------- 192 Total number of votes cast for Seattle Newspaper Guild, Local No. 82-------------------------------------------------------- 145 Total number of votes cast against Seattle Newspaper Guild, Local No 82-------------------------------------------------------- 47 Total number of blank ballots----------------------------------- 0 Total number of special ballots--------------------------------- 3 Total number of void ballots------------------------------------ 0 Total number of challenged votes-------------------------------- 0 Total number of eligible voters not voting----------------------- 5 By virtue of. and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Rela- tions Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 1, as amended, IT IS HEREBY OERTIFIED that Seattle Newspaper Guild, Local No. 82, has been selected by a majority of the employees of the Seattle Post- Intelligencer Department of Hearst Publications, Inc., a corporation, employed in the editorial, classified advertising, display advertising, promotion, circulation, and purchasing departments, the business office and the outside telephone crew, but excluding Home Edition District Men Helpers-Seattle ; District Man-Tacoma ; Branchmen ; Branchmen's Helpers; Street Circulators-Seattle; Street Circula- tors-Portland; Roadmen; the following assistants to the Circula- tion Manager, namely, Branch Manager, Canvasser Manager, and Country and Suburban Circulator; Traffic Clerks; Return Clerks; Canvassers-City ; Canvassers-Outside City ; and Motor Route Drivers, and excluding also all executives and department managers but including all other supervisors, as their representative for the purposes of collective bargaining, and that, pursuant to Section 9 (a) of the Act, Seattle Newspaper Guild, Local No. 82, is the exclu- sive representative of all such employees for the purposes of collec- tive bargaining in respect to rates of pay, wages, hours of employ- ment and other conditions of employment.
