ORDER DENYING APPEAL
On June 13, 1957 , counsel for the General Counsel requested special
permission to appeal the Trial Examiner's denial of a motion to
dismiss the complaint in the above -entitled proceeding on the ground
that the Charging Union failed to renew its full compliance with
Section 9 (g) of the Act within the 90-day grace period , citing
Monsanto Chemical Company, 115 NLRB 702.
Having duly considered the matter , the Board has decided to deny
the request on the basis of Standard Cigar Company, 117 NLRB 852,
having issued on this same date an Administrative Determination
with respect to the compliance status of the Charging Union.

ADMINISTRATIVE DETERMINATION OF
COMPLIANCE STATUS
On June 26, 1957, the Board issued a notice to show cause in the
above-entitled proceeding why the Board should not administratively
determine that the Union de Trabajadores de Muelles y Ramas Anexas
de Ponce, P. R., Local 1903, IBL-AFL-CIO, has failed to renew its
full compliance with Section 9 (g) of the Act within the 90-day grace
period, and why any action taken on behalf of this Union during such
period should not be withdrawn or revoked under the policy announced
in Monsanto Chemical Company, 115 NLRB 702. On July 8, 1957, the
Union filed a response thereto.
The Board, having duly considered the matter, has decided that the
Union has not shown good cause within the meaning of Monsanto,
having failed to show that circumstances beyond the Union's control
prevented timely compliance.
IT IS THEREFORE ADMINISTRATIVELY DETERMINED that the Union de
Trabaj adores de Muelles y Ramas Anexas de Ponce, P. It., Local 1903,
