Oct. 13, 2010) Copy Citation JD-(SF)-38-10 UNITED STATES OF AMERICA BEFORE THE NATIONAL LABOR RELATIONS BOARD DIVISION OF JUDGES SAN FRANCISCO BRANCH OFFICE PLEASANT TRAVEL SERVICES, INC. d/b/a ROYAL KONA RESORT Cases 37-CA-7806 37-CA-7848 and 37-CA-7849 37-CA-7867 37-CA-7868 UNITE HERE!, LOCAL 5 37-CA-7883 37-CA-7892 37-CA-7893 37-CA-7939 CORRECTIONS ORDER It having been brought to my attention by counsel for the Acting General Counsel that I inadvertently omitted any reference to the surveillance and threat allegations found unlawful at pages 17 and 18 of my September 28, 2010, decision (JD(SF)-38-10) in the sections designated as Conclusions of Law, Order, and the Notice to Employees, I hereby issue the following corrections. 1. Renumber Conclusions of Law 4, 5, and 6, to 6, 7, and 8, respectively, and insert the following paragraphs as Conclusions of Law 4 and 5. 4. By engaging in surveillance of the employee leafleting activities on September 9, 2009, Respondent has violated Section 8(a)(1) of the Act. 5. By threatening to discipline off-duty employees engaged in leafleting activity in non- work areas at its facility without a property pass on September 9 and October 14, 2009, Respondent has violated Section 8(a)(1) of the Act. 2. Redesignate subparagraphs 1(d) and (e) of the Order to subparagraphs 1(f) and 1(g), respectively, and insert the following as subparagraphs 1(d) and (e). (d) Engaging in surveillance of employee leafleting activities protected by Section 7 of the Act. (e) Threatening to discipline off-duty employees for engaging in union leafleting activities in nonwork areas of its premises without a property pass. 3. Insert the following paragraphs in the Notice to Employees immediately before the paragraph that begins, “WE WILL NOT discipline off-duty employees . . ..†WE WILL NOT engage in surveillance of employee leafleting activities protected by Section 7 of the Act. 2 WE WILL NOT threaten to discipline off-duty employees for engaging in union leafleting activities in nonwork areas of the resort without a property pass.
