DECISION AND CERTIFICATION OF REPRESENTATIVES STATEMENT OF THE CASE Upon petition duly filed by International Typographical Union (Youngstown Local No. 200, Unaffiliated), herein called the Union, alleging that a question affecting commerce had arisen concerning the representation of employees of Republic Steel Corporation, Cleve- land, Ohio, herein called the Company, engaged in the manufacture, sale, and distribution of iron and steel products, the National Labor Relations Board provided for an appropriate hearing upon due notice. On October 1, 1942, before a hearing was held, the Company, the Union, and the Regional Director for the Eighth Region (Cleveland, Ohio), entered into a "Stipulation for Certification Upon Pay Roll Check." Pursuant to the stipulation, a check of the union membership rec- ords against the Company's pay roll of September 20, 1942, was made under the supervision of the Acting Regional Director. On Octo- ber 5, 1942, the Acting Regional Director, pursuant to the stipulation, issued a Report on Cross Check, copies of which were duly served upon the parties. No objections to the conduct of the cross check or to the Report on Cross Check have been filed by either of the parties. In his report, the Acting Regional Director reported that the check of the Union's records and the Company's pay roll showed that .8 of the 8 'employees in the agreed appropriate unit had authorized the - • 44 N. Upon the basis of the stipulation, the Report on Cross Check, and the entire record in the case, the Board makes the following : FINDINGS OF FACT 1. A question affecting commerce has arisen'concerning the repre- sentation of the employees in the Printing Department of Republic Steel Corporation, Cleveland, Ohio, within the meaning of Section 9 (c) and Section 2 (6) and (7) of the Act. 2. All hand compositors and type setting machine operators exclud- ing supervisory employees in the Printing Department of the Republic Steel Corporation, Cleveland, Ohio, constitute a unit appropriate for the purposes of collective bargaining within the meaning of Section 9 (b) of the Act. 3. International Typographical Union (Youngstown Local No. 200, Unaffiliated), has been designated and selected by a majority of the employees in the above unit as their representative for the purposes of collective bargaining and is the exclusive representative of all the employees in said unit within the meaning of Section 9 (a) of the Act. CERTIFICATION OF REPRESENTATIVES By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (b) of the National Labor Relations Act, IT Is HEREBY CERTIFIED that International Typographical Union (Youngstown Local No. 200, Unaffiliated) has been designated and selected by a majority of the hand compositors and type setting ma- chine operators excluding supervisory employees in the Printing De- partment of the Republic Steel Corporation, Cleveland, Ohio, as their representative for the purposes of collective ' bargaining, and that pursuant to the provisions of Section 9 (a) of the Act, International Typographical Union (Youngstown Local No. 200, Unaffiliated), is the exclusive representative of all said employees for the purposes of collective bargaining with respect to rates of pay, wages, hours of employment, and other conditions of employment. 1 Subsequent to the completion of the cross check, a - .pot check was made in the field among the employees in accordance with Section 8 (a) of the stipulation . Two employees were selected for this spot check and both verified the L ' nion's records previously checked as correctly stating their union membership status.
