DECISION AND CERTIFICATION OF REPRESENTATIVE
The National Labor Relations Board, by a three-member panel, has considered
objections to a mail ballot election, in which the ballots were mailed to voters on July 22,
2013 and counted on August 12, 2013, and the hearing officer’s report recommending
disposition of them. The election was conducted pursuant to a Stipulated Election
Agreement. The tally of ballots shows 11 ballots for the Petitioner, 108 ballots for the
Intervenor, 5 ballots for no union, 6 void ballots, and 8 challenged ballots, an insufficient
number to affect the results.
The Board has reviewed the record in light of the exceptions and brief, has
adopted the hearing officer’s findings and recommendations, and finds that a

certification of representative should be issued.1
CERTIFICATION OF REPRESENTATIVE
IT IS CERTIFIED that a majority of valid ballots have been cast for United
Electrical, Radio and Machine Workers of America (UE), Local 1177, and that it is the
exclusive collective-bargaining representative of the employees in the following
appropriate unit:
All full-time and regular part-time road drivers, yard drivers, radius drivers,
yard managers and yard coordinators employed by the Employer at, or out
of rail yards currently located at: 14000 South Halsted, Riverdale, IL
60287 (Blue Island Yard); 6900 South Central, Bedford Park, IL 60638
(BRC Yard): 5601 West 26th Street, Cicero, IL 60804 (Cicero Yard); 3611
West 38th Street, Chicago, IL 60632 (Corwith Yard); 685 McClure Road,
Aurora, IL 60503 (Eola Yard); 26664 South Baseline Road, Elwood, IL
60425 (LPC Yard); 9400 Fullerton, Franklin Park, IL 60131 (Norpaul
Yard); 2721 161st Street, Hammond, IN 46323 (Gibson Yard); 7600 Santa
Fe Drive, Hodgkins, IL 60527 (Willow Springs Yard); and 3821 Michigan
Avenue, East Chicago, IN 46312 (IHB-Michigan Avenue Yard); but
excluding all office clerical employees and guards, professional
employees and supervisors as defined in the National Labor Relations
Act.

1 The Petitioner has excepted to some of the hearing officer’s credibility findings. The
Board’s established policy is not to overrule a hearing officer’s credibility resolutions
unless the clear preponderance of all the relevant evidence convinces us that they are
incorrect. Stretch-Tex Co., 118 NLRB 1359, 1361 (1957). We have carefully examined
the record and find no basis for reversing the findings.
