Dep’t of Justice (FBI), EEOC Appeal No. 2019005164 (August 31, 2020). EEOC Regulation 29 C.F.R. § 1614.405(c) provides that a request for reconsideration to the Commission must be filed within 30 calendar days after a complainant receives the appellate decision. The Commission will dismiss any request that is not filed in a timely manner, unless extenuating circumstances prevented the timely filing of the request. The EEOC issued its decision in this matter on August 31, 2020. Our prior decision indicated in the certificate of mailing that there was a five-day presumption of receipt. Complainant filed her request for reconsideration on November 12, 2020, which is beyond the 30-day time limit. Complainant has offered no explanation for her untimely filing. Therefore, Complainant’s request is dismissed for untimeliness. The decision in EEOC Appeal No. 2019005164 remains the Commission’s decision.
