I. 0., on May 28, 1937, requesting an investigation and certi- fication of representatives of the employees of the above-named Com- pany, a hearing having been held before a Trial Examiner duly designated, and the Board having issued a Decision and Direction of Election in this matter,l amending the designation of the petitioner and substituting as the petitioner Lumber and Sawmill Workers Union Local No. 53 of International Woodworkers of America, and an election, pursuant to said Direction of Election, having been con- ducted by the Regional Director for the Twentieth Region, and the Board, by Order duly made, having permitted the petitioner to file with the Board in Washington, D. C., objections to the ballot and to the Intermediate Report on Secret Ballot of said Regional Direc- tor, and having directed the said Regional Director to conduct an investigation and provide for an appropriate hearing upon due notice upon said objections, and thereafter the petitioner having filed with the Board and served upon all parties herein a petition, requesting that it be permitted to withdraw its petition for investigation and certification of representatives of employees of the above-named Com- pany and that all proceedings on said petition be quashed and nulli- fied, and the Board having, on October 29, 1938, given due notice that on this date, November 9, 1938, unless sufficient cause to the contrary should then appear, it would permit the withdrawal of the said petition, and no sufficient cause to the contrary appearing: and the Board having duly considered the matter, IT IS HEREBY ORDERED that the request of the petitioner for permis- sion to withdraw its petition be, and it hereby is, granted, and the aforesaid case be, and it hereby is, closed.
