Case 17-CA-6199 February 13, 1978 SUPPLEMENTAL ORDER BY CHAIRMAN FANNING AND MEMBERS PENELLO AND MURPHY On August 12, 1977, the Acting Regional Director for Region 17 issued a backpay specification and notice of hearing in this proceeding in which he concluded that Elei G. Florence and Edward Force, previously found to have been unlawfully disc- harged,' were entitled to backpay of $11,479.96 and $14,423.53, respectively. On November 4, the Re- spondent sent a letter to the Regional Director in which it admitted "all the material allegations in the backpay specification." Thereafter the General Counsel filed a motion with the Board in which he requested that this proceeding be transferred to the Board and that the Board issue a Supplemental Decision finding that the allegations set forth in said specification are true and correct and issue an order requiring the Respondent to make the discriminatees whole in the amounts of backpay set forth in the specification. On November 23, 1977, the Board issued its Order transferring the proceeding to the I 220 NLRB 295(1975), enfd. 542 F.2d 1178(C.A. 8, 1976). Board and its Notice To Show Cause why the General Counsel's motion with respect to the back- pay matter should not be granted. No response was filed to the Notice To Show Cause. Consequently, there is no question raised concerning the truth and accuracy of the backpay specification and no opposi- tion to the Board's issuing an order requiring the Respondent to pay the discriminatees the sums set forth in that specification. The Board, having thus duly considered the matter, concluded that, upon the basis of the backpay specification, the provisions of which are conceded to be true and accurate and, in accord with the unopposed request of the General Counsel set forth in his motion, an order should issue requiring that Respondent pay discriminatees Elei G. Florence and Edward Force the sums specified in the backpay specification. IT IS HEREBY ORDERED that the Respondent, Ameri- can Theatre Corporation d/b/a Pussycat Theatre; Downtown Books, Inc.; and Global Industries, Inc., make whole the discriminatees named below, by payment to them of the amount following their names plus interest accrued at the rate of 6 percent per annum to be computed in the manner set forth in Isis Plumbing & Heating Co., 130 NLRB 716 (1962), until payment of all backpay due is made, less Federal and state tax withholdings.
