AMENDMENT TO DIRECTION- OF ELECTION

On, March 18,'1942, the National Labor Relations Board, herein
called' the Board , issued a Decision and Direction of Election in the
above-entitled proceeding.' -
The Board , having been advised that United Construction Work-
ers Organizing Committee , affiliated with the Congress of Industrial
Organizations , does not desire to appear upon the ballot, hereby
amends the Direction of Election by striking therefrom the words
"to determine whether they desire to be represented by International
Hod Carriers, Building ` and Common Laborers Union of America,
Local 1410, affiliated with the ;American Federation of Labor,-or by
United = Construction Workers Organizing Committee, affiliated with
the ' Congress of Industr- al Organizations , for-the purpose of collec-
tive bargaining , or by neither" and substituting therefor the -words
"to determine whether or not they desire to be represented by Inter-
national Hod Uarriers , Building and Common Laborers Union of
America, Local 1410 , affiliated with the American Federation of
Labor, for the purposes of collective bargaining."

CERTIFICATION OF REPRESENTATIVES
April 30, 1940
`. On March 18, 1942, and April 16, 1942, respectively, the National
Labor Relations Board, herein called the Board, issued its Decision
and Direction of Election 1 and Amendment to Direction of Election,2
in the above-entitled proceeding. Pursuant to the Direction of
Election, as amended, an election by secret ballot was conducted on
April 17, 1942, under the direction and supervision of the Regional
Director for the Ninth Region (Cincinnati, Ohio). On April 18,
1942, the Regional Director, acting pursuant to Article III, Section 9,
of National Labor Relations Board Rules and Regulations-Series 2,
as amended, issued an Election Report, copies of which were duly
served upon the parties. No objections to the conduct of the ballot
or to the Election Report have been filed by any of the parties.
As to the balloting and the results thereof, the 'Regional Director
reported as follows :

as amended,
IT IS HEREBY CERTIFIED that International Hod Carriers, Building
and Common Laborers Union of America, Local 1410, affiliated with
the American Federation of Labor, has been designated and selected
by -a majority' of all production and maintenance employees of Price
Brothers Co. at its East Monument Avenue plant in Dayton, Ohio,
including engineers, but excluding salesmen, office, clerical and super-
visory employees, gravel-plant employees,, erection crews, and those
working outside the plant, as their representative for the purposes of
collective bargaining,-and that, pursuant to Section 9 (a) of the Act,
International Hod Carriers, Building and Common Laborers Union
of America, Local 1410, affiliated with the American Federation of
Labor, is the exclusive representative of all such employees for the
purposes of collective bargaining in respect to rates of pay, wages,
hours of employment, and other conditions of. employment.
