Anthony was ordered to show cause why judgment should not be entered 1
against it. Paper 3. Anthony filed a response, in which Anthony states that it 2
“does not contest entry of judgment against it with respect to the sole Count in 3
interference.” Paper 12. Anthony’s statement is construed as a request for entry of 4
adverse judgment. 37 C.F.R. §41.127(b). Anthony’s request is granted. 5
Accordingly, it is 6
ORDERED that judgment is entered against Anthony for count 1 7
(Paper 1 at 4); 8
FURTHER ORDERED that claims 27-31, 33 and 34 of Anthony’s 9
involved application are FINALLY REFUSED, 35 U.S.C. § 135(a); 10
FURTHER ORDERED that the parties shall note the requirements 11
of 35 U.S.C. § 135(c) and Bd.R. 205; and 12
FURTHER ORDERED that a copy of this judgment be entered in 13
the administrative records of the involved Anthony application and Pon patent. 14
