On February 10, 2015, a joint motion to terminate this inter partes
review was filed by Petitioner and Patent Owner. Paper 9. Petitioner and
Patent Owner also filed a copy of their written settlement agreement
covering Patent 7,707,250 involved in this inter partes review. Ex. 1031.
Petitioner and Patent Owner also jointly request to have their settlement
agreement treated as confidential business information under 35 U.S.C.
§ 317(b) and 37 C.F.R. § 42.74(c). Paper 9. Petitioner and Patent Owner
represent that the settlement agreement filed as Exhibit 1031 is a true and
accurate copy of their settlement agreement. Id.
Patent Owner has not yet filed a response in this proceeding. The
Board determines that in these circumstances it is appropriate to terminate
review both as to Petitioner and Patent Owner. See 35 U.S.C. § 317(a); 37
C.F.R. § 42.72.
It is
ORDERED that the joint motion to terminate IPR2015-00077 is
granted, and this inter partes review is hereby terminated; and
FURTHER ORDERED that the joint request to have the settlement
agreement treated as business confidential information under 37 C.F.R.
§ 42.74(c) is granted.
