Case No. R-2499 SUPPLEMENTAL DECISION AND CERTIFICATION OF REPRESENTATIVES August 6, 1941 On June 5, 1941, the National Labor Relations Board, herein called the Board, issued a Decision and Direction of Election in the above- entitled proceeding., Pursuant to the Direction of Election, an election by secret ballot was conducted on July 2, 1941, under the direction and supervision of the Regional Director for the Tenth Region (Atlanta, Georgia). On July 8, 1941, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, issued and duly served upon the parties an Election Report on the ballot. As to the balloting and its results, the Regional Director reported as follows : Total on eligibility list---------------------------------- 74 Total number of ballots cast---------------------------- 72 Total number cast for International Association of Bridge, Structural & Ornamental Iron Workers, Shopmen's Local Iron Workers No. 530, A. F. of L------------------------ 31 Total number cast for Steel Workers Organizing Committee, C. I. 0------------------------------------------------ 37 Total number cast for neither---------------------------- 0 Total number of challenged ballots----------------------- 4 Total number of void ballots----------------------------- 0 Total number of blank ballots. ---------------------------- 0 On July 12 and July 14, 1941, the International Association of Bridge, Structural & Ornamental Iron Workers, Shopmen's Local Iron Workers No. 530, A. F. of L., filed its Objections to Conduct of the Ballot and Election Report. On July 23, 1941, the Regional Director issued a Report On Objections. We have considered the objections and the Regional Director's Report thereon and find that 132N L It B 295 33 N. L R B, No 190 1151 1152 DECISIONS OF NATIONAL LABOR RELATIONS BOARD the objections raise no substantial or material issues with respect to to the conduct of the ballot.2 The objections are hereby overruled. By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Rela- tions Act, 49 Stat. 449, and pursuant 'to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, IT IS HEREBY CERTIFIED that Steel Workers Organizing Committee, C. I. 0., has been designated and selected by a majority of all em- ployees of Pidgeon Thomas Iron Company employed at Memphis, Tennessee, including those in the wholesale warehouse, the shop ware- house, and the shop, the maintenance men, shopmen, shop blacksmith, night watchmen, truck drivers, and the office porters, but excluding supervisory, office, clerical, and sales employees, as their representative for the purposes of collective bargaining, and that, pursuant to Section 9 (a) of the Act, Steel Workers Organizing Committee, C. I. 0., is the ekclusive representative of all such employees for the purposes of collective bargaining with respect to rates of pay, wages, hours of employment, and other conditions of employment. 2 The Objections also state that the superintendents , foremen, and shipping clerks should have been included in the appropriate unit because these men spend all of their time in production work.
