On June 16, 1942, the National Labor Relations Board issued a
Decision and Direction of Election in this proceeding 1 Pursuant to
the Direction of Election, an election by secret ballot was conducted
on June 30, 1942, under the direction and ' supervision of the Re-
gional Director for the Sixteenth Region (Fart Woith, Texas).. On
July 2, 1942, the Regional Director, acting pursuant to Article III,
Section 9, of National Labor Relations Board Rules and Regula-
tions-Series 2, as amended, issued and duly served upon the parties
an Election Report
As to the balloting and its results, the Regional Director reported
as 'follows .

On July 11, 1942, Copper Refinery' Workers, Local 23109 (AFL),
filed objections to the conduct of the election and the Election Report.
Thereafter the Regional Director issued a Report on 'Objections.
The Board has considered the Election Report, the objections thereto,
and the Regional Diiectoi's Report on Objections and finds that tha
objections do not raise substantial or m tteiial issues with respect to
the conduct of the ballot or the Election Report The objections are
hereby overruled.

CERTIFICATION OF REPRESENTATIVES -
By virute of and pursuant to the, power vested in the National
Labor Relations Boaid by Section 9 (c) of the National Labor, Re-
lations Act, 49 Stat 449, and pursuant to Article III, Sections 8 and
9, of National Labor Relations Board Rules and Regulations-Series
2, as amended,
IT IS HEREBY CERTIFIED that local 501, International Union of Mine,
Mill & Smelter Workers (CIO), has been designated and selected
by a'majority of all hourly paid production and maintenance em-
ployees of Phelps Dodge Refining Corporation, El Paso, Texas, at its
El Paso plant, including working leaders, J Evans, S. Brown, Jose
Chavez, and T Thorpe, but excluding S Gonzales, M R Osborne, all
employees in the purchasing, accounting, labor and police, engineer-
ing, and laboratory depaitments, clerical employees, shift bosses and
other supervisory employees, watchmen, janitors, gardeners, and
temporary construction employees, as their representative for the :
purposes of collective bargaining and that, pursuant to Section 9 (a)
of the National Labor Relations Act, Local 501, International Union
of Mine, Mill & Smelter Workers (CIO), is the exclusive represent-
ative of all such employees for the purposes of collective bargaining
with respect to rates of pay, wages, hours of employment, and other
conditions of employment.
