The election was conducted pursuant to a Stipulated Election Agreement. The revised tally of ballots shows 6 ballots cast for the Petitioner, and 5 ballots cast against the participating labor organization. There was 1 challenged ballot, a sufficient number to affect the results. No exceptions have been filed to the hearing officer's report within the time provided. Accordingly, the Board adopts the hearing officer's findings and recommendations.1 1 The Union challenged the ballot cast by Santos Bautista. The Hearing Officer recommended that the Union’s challenge to the ballot cast by Bautista be overruled, that his ballot be opened and counted, and a third revised tally and appropriate certification issue. 2 ORDER IT IS ORDERED that this proceeding is remanded to the Regional Director for Region 19 for further appropriate action consistent with the hearing officer's report.
