Aug. 29, 2013) Copy Citation Griffith, Indiana UNITED STATES OF AMERICA BEFORE THE NATIONAL LABOR RELATIONS BOARD PAN-O-GOLD BAKING COMPANY Employer and INTERNATIONAL BROTHERHOOD OF TEAMSTERS LOCAL UNION 142 Petitioner Case 13-RC-103125 DECISION AND DIRECTION The National Labor Relations Board has considered a challenged ballot in an election held April 18, 2013, and the hearing officer's report recommending disposition of it. The election was conducted pursuant to a Decision and Direction of Election. The tally of ballots shows 4 ballots cast for and 3 ballots cast against the Petitioner, with 1 challenged ballot, a sufficient number to affect the results. No exceptions have been filed to the hearing officer's report within the time provided. Accordingly, the Board adopts the hearing officer's findings and recommendations. 1 1 The Hearing Officer did not find that the evidence presented was sufficient to sustain the challenge filed by the Petitioner, Teamsters Local 142, and therefore recommended that the challenged ballot cast by Tom Krause be overruled and counted. DIRECTION IT IS DIRECTED that the Regional Director for Region 13 shall, within 14 days of this direction, open and count the ballot of Tom Krause, and thereafter prepare and serve on the parties a revised tally of ballots, and issue the appropriate certification.
