LORILLARD COMPANY, INC. and CIGARMAKERS' INTERNATIONAL UNION OF AMERICA Case No. R-190 CERTIFICATION OF REPRESENTATIVES April 03, 1938, On September 1, 1937, the National Labor Relations Board, herein, called the Board, issued a Decision and Direction of Election in the above-entitled case 1 The Direction of Election provided that an: election by secret ballot be conducted within fifteen (15) days front. the date of the Direction among all the production employees paid on an hourly and piece-rate basis, and all maintenance employees, exclu-- sive of machinists, specialists, machinists' apprentices, and machin- ists' helpers, who were employed in the Richmond, Virginia, plant of P. Lorillard Company, Inc., on June 21, 1937, to determine whether they desire to be represented by Cigarmakers' International Union of America, for the purposes of collective bargaining. Pursuant to the Direction, an election by secret ballot was (,on- ducted on September 14, 1937. Full opportunity was accorded to all the,parties to this investigation,to participate in the conduct of the secret ballot and to make challenges. Thereafter, Bennet F. Schautller, Regional Director for the Fifth Region (Baltimore, Mary- land), acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 1, as ameucled, is- sued and duly served upon the parties an Intermediate Report on the election. No objections or exceptions to the Intermediate Report. have been filed by any of the parties. As to the balloting and its results, the Regional Director reported' as follows : Total number of ballots counted-------------------------- 2,038 Total number of votes for Cigarmakers' International Union of America--------------------------------------------- 1,975 Total number of votes against Cigarmakers ' International Union of America-------------------------------------- 60 Total number of blank ballots----------------------------- 2 Total number of void ballots------------------------------ I Total number of challenged ballots ------------------------ 0 1 3 N L R B 529 778 DECISIONS AND ORDERS 779 By virtue of and pursuant to the power vested in the National Tabor Relations Board by Section 9 (c) of the National Labor Re- lations Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations- Series 1, as amended, IT IS rrEREBY CERTrFrED that Cigarmakers' International Union of America has been selected by a majority of the production employees paid on an hourly and piece-rate basis, and maintenance employees, "exclusive, of machinists, specialists, machinists' apprentices, and machinists' helpers, employed in the Richmond, Virginia, plant of P. Lorillard Company, Inc., as their representative for the purposes of collective bargaining, and that, pursuant to the provisions of Section 9 (a) of the National Labor Relations Act, Cigarmakers' International Union of America is the exclusive representative of all such employees for the purposes of collective bargaining in respect to rates of pay, wages, hours of employment, and other conditions of employment.
