Spelman, of counsel to the Board: DECISION AND CERTIFICATION OF REPRESENTATIVES STATEMENT OF THE CASE Upon petition duly filed by United Steelworkers of America,, herein called the Union, alleging that a question affecting commerce had arisen concerning the representation of employees of Oil Well Supply Company, Dallas, Texas, herein called the Company, engaged in the manufacture and sale of oil, country machinery, equipment, supplies, and war materials at plants in Oil City and Braddock, Pennsylvania; the National Labor Relations Board provided for an appropriate hear- ing upon due notice. On July 16, 1942, before a hearing was.held, the Company, the Union, and the Acting Regional Director for the Sixth Region (Pittsburgh, Pennsylvania), entered into a "Stipulation for Consent • Elections and Certification by National Labor Relations Board." Pursuant to the stipulation, elections by secret ballot were conducted on June 26, 1942, under the direction and supervision of the Acting Regional Director, among all employees of the Company at the Im- perial Works and at the Wilson-Snyder Works, excluding foremen, 'On July 6, 1942, the Union filed a motion to have the name United Steelworkers of America substituted for its former name , Steel Workers Organizing Committee On July 16, 1942 , the Boaid issued its notice of intention to make the desired substitution , copies of which notice were served on the parties. On July 24 , no objections to the proposed substi- tution having been filed , the Board issued its order substituting the name Uhited Steel- workers of America for Steel Workers Organizing Committee. 44 N. On September 3, 1942, the Acting Regional - Diiector issued and duly served on,the parties Election Reports on, the ballots. No objections to the conduct of , the ballot or the Election Report of the Wilson-Snyder plant have been filed by any of the parties. Objections to the election at the Imperial Works plant were filed by the Pattern makers League of North America and -said objec- tions were dismissed by the Regional Director. Total on eligibility list----------------------------------- 1,063 Total ballots cast________________________________________ 962 Total ballots challenged ___________________________________ 0 Total blank ballots --------------------------------------- 0 Total void ballots_________________2 Total valid votes counted_________________________________ 960 Votes cast for United Steelworkers of America ______________ 877 Votes cast against United Steelworkers of America ---------- 83 Upon the basis of the stipulation , the Election Reports , and the entire record in the case, the Board makes the following : FINDINGS OF FACT 1.'A question affecting commerce has arisen concerning the repre- sentation of employees of Oil Well Supply Company, Dallas, Texas, within the meaning of Section 9 (c) and Section 2 (6) and (7) of the National Labor Relations Act. 2. All employees of the Company at the Wilson-Snyder Works and at the Imperial Works, excluding foremen, assistant foremen, supervisors in charge of any classes of labor, watchmen, guards, con- fidential clerical employees regardless of method of compensation 472 DECISIONS OF NATIONAL LABOR RELATIONS BOARD (but excluding other clerical employees on-an hourly-wage rate basis);, and salaried employees, constitute a unit appropriate for the purposes of collective bargaining within the meaning of Section- 9 (b) of the Act. 3. United Steelworkers of America has been designated and selected' by a majority. of the employees in the' above unit as their repre-: sentative for the purposes of collective bargaining and is the exclusive representative of all employees in said unit within the meaning of, Section 9 (a) of the Act. CERTIFICATION OF REPRESENTATIVES By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Relations Act, IT IS HEREBY CERTIFIED that United Steelworkers of America has been designated and selected by a majority of all employees of Oil Well Supply Company, Dallas, Texas, at the Imperial Works and at the Wilson-Snyder Works, excluding foremen, assistant foremen, supervisors in charge of any classes of labor, watchmen, guards, con- fidential clerical employees regardless of method of compensation (but not excluding other clerical employees on an hourly wage rate basis), and salaried employees, as their representative for the pur- poses of collective bargaining, and that pursuant to Section 9 (a) of the Act, United Steelworkers of America is an exclusive repre- sentative of such employees for the purposes of collective bargaining with respect to rates of pay, wages, hours of employment, and, other conditions of employment.
