Oct. 3, 2014) Copy Citation Commerce City, CO Cheyenne, WY UNITED STATES OF AMERICA BEFORE THE NATIONAL LABOR RELATIONS BOARD NPL CONSTRUCTION, CO., Employer and SHANE SWEETALLA Petitioner and LABORERS INTERNATIONAL UNION OF NORTH AMERICA LOCAL 720 Union Case 27-RD-129800 DECISION AND DIRECTION The National Labor Relations Board has considered challenged ballots in an election held July 9, 2014, and the Hearing Officer’s report recommending disposition of them. The election was conducted pursuant to a Stipulated Election Agreement. The tally of ballots shows 11 ballots cast for the Union, and 15 ballots cast against the Union, with 16 challenged ballots, a sufficient number to affect the results. No exceptions have been filed to the Hearing Officer’s report within the time provided. Accordingly, the Board adopts the Hearing Officer’s findings and recommendations.1 1 The Hearing Officer recommended that the challenges to the 16 ballots at issue be overruled 2 DIRECTION IT IS DIRECTED that the Regional Director for Region 27 shall, within 14 days of this direction, open and count the ballots of Baudelio Casillas, Raul Gonzales-Sanchi, Juan Nevarez, Jorge Rivera, Adolfo Archuleta, Steve Barnes, James Botello, Jose Casillas, Miguel Cobain, Pedro Gomez, Miguel Mercado Paredes, Jose Miramontes, Eligio Nevarez, Jose Nevarez, Efren Sanchez, and Brett Whitetree be opened and counted. The Regional Director shall thereafter prepare and served on the parties a revised tally of ballots, and issue the appropriate certification(s). Dated, Washington, D.C., October 3, 2014.
