Nov. 12, 2015) Copy Citation November 12, 2015 Re: Northeastern Land Services, LTD d/b/a The NLS Group Case 01-CA-039447 ORDER On October 13, 2015, counsel for the General Counsel, the Charging Party, and the Charged Party filed an All-Party Motion to Approve Settlement Agreement and Remand to Regional Director for Further Proceedings. In this joint motion, the parties ask the Board to approve a negotiated Settlement Agreement and Mutual Release that resolves all remaining compliance issues in a case that originated before the Board in 2001. All parties have signed and approved the settlement agreement, and the Charging Party is the only affected employee; the settlement is reasonable in light of the stage of the litigation (post-enforcement), the inherent risks involved in litigating the remaining compliance issues, and the otherwise continued delay in providing remedial relief; there is no indication that the settlement was obtained through fraud, coercion, or duress; and the Charged Party has no history of violations or of breaching previous settlement agreements. Moreover, the parties represent that the Settlement Agreement offers the additional benefit of disposing of potential collateral claims beyond the Act. Because approval of the Settlement Agreement will effectuate the purposes and policies of the Act, we approve the Settlement Agreement. Additionally, we grant the parties’ request to remand to the Region for further proceedings to effectuate compliance consistent with the terms of the Settlement Agreement. Accordingly, we grant the All-Party Motion to Approve Settlement Agreement and Remand to Regional Director for Further Proceedings. This matter is remanded to the Regional Director for Region 1 of the National Labor Relations Board for further appropriate action. By direction of the Board: /s/ Leigh A.
