Jun. 21, 2011) Copy Citation Newark, NJ UNITED STATES OF AMERICA BEFORE THE NATIONAL LABOR RELATIONS BOARD NEWARK EXTENDED CARE FACILITY Employer and 1199 SEIU, UNITED HEALTHCARE WORKERS EAST, NEW JERSEY REGION Petitioner Case 22-RC-13203 DECISION AND ORDER The National Labor Relations Board has considered objections to an election held April 14, 2011, and the Regional Director's report recommending disposition of them. The election was conducted pursuant to a Stipulated Election Agreement among two groups of employees, Group “A†(professional employees) and Group “B†(nonprofessional employees). The professional employees in Group “A†voted on two questions: (1) whether they wished to be included in a single unit with nonprofessional employees in Group “B†and (2) which labor organization, if any, they wished to be represented by for the purposes of collection-bargaining. The nonprofessional employees in Group “B†voted on one question: which labor organization, if any, they wished to be represented by for the purpose of collective-bargaining. The revised tally of ballots (on the question of inclusion) shows 2 ballots cast in favor of inclusion with the nonprofessional employees, 1 ballot cast against inclusion, with no challenged ballots. The tally of ballots (on the question of representation) shows 130 ballots cast for the Petitioner, 78 ballots cast for the 2 Intervenor,1 and 1 ballot cast against the participating labor organizations. There were 3 challenged ballots, an insufficient number to affect the results. No exceptions have been filed to the Regional Director's report within the time provided. Accordingly, the Board adopts the Regional Director's findings and recommendations. ORDER IT IS ORDERED that this proceeding is remanded to the Regional Director for Region 22 for further appropriate action consistent with his report. Dated, Washington, D.C., June 21, 2011.
