1 This case involves the Board’s Final Rule on representation case procedures, with which
Chairman Miscimarra disagrees for the reasons expressed in his dissenting views in the Final
Rule. See 79 Fed.Reg. 74308, at 77430-74460 (Dec. 15, 2014) (dissenting views of Members
Miscimarra and Johnson). In the instant case, Chairman Miscimarra agrees with the denial of the
Employer’s request to stay the election or alternatively to impound the ballots, without prejudice
to the Board’s consideration of the Employer’s pending Request for Review.
