Employer and NEW YORK STATE NURSES ASSOCIATION Petitioner Case 02-RC-126994 DECISION AND DIRECTION The National Labor Relations Board has considered challenged ballots in an election held between May 27 and June 10, 2014, and the Regional Director's report recommending disposition of them. The election was conducted pursuant to a Stipulated Election Agreement. The tally of ballots shows 8 ballots cast for and 9 ballots cast against the Petitioner, with 2 challenged ballots, a sufficient number to affect the results. No exceptions have been filed to the Regional Director's report within the time provided. Accordingly, the Board adopts the Regional Director's findings and recommendations.1 1 The ballots of Kristen Finazzo and Michael Greco were challenged by the Employer on the grounds that they had resigned from employment with the Employer prior to the election, and therefore were ineligible to vote. The Regional Director recommended overruling the challenged ballots, and recommended that the ballots of Kristen Finazzo and Michael Greco be opened and counted. 2 DIRECTION IT IS DIRECTED that the Regional Director for Region 2 shall, within 14 days of this direction, open and count the ballots of Kristen Finazzo and Michael Greco, and thereafter prepare and serve on the parties a revised tally of ballots, and issue the appropriate certification.
