R-814 and C-1141 AMENDED DIRECTION OF ELECTION December 928, 1939 On September 7, 1939, the National Labor Relations Board, herein called the Board, issued a Decision, Order, and Second Direction of Election in the above-entitled proceedings.' The Direction of Elec- tion provided that an election by secret ballot be conducted at such time as the Board "shall hereafter direct" among all production employees of the respondent at his Millville, New Jersey, plant, ex- cluding foremen and foreladies and other supervisory employees, janitors, truck drivers, mechanics, office help, and employees in the shipping department, and including inspectors and packers, to de- termine whether they desire to be represented by Federal Labor Union No. 21560 or by Amalgamated Clothing Workers of America for the purposes of collective bargaining or by neither. Thereafter, the Regional Director reported to the Board that the respondent has complied with the Board's Order contained in its Decision of September 7, and recommended that the Board set a date for the conduct of the election. Accordingly, we shall set the date for the conduct of the election. We shall direct that employees in the appropriate unit during the pay-roll period immediately pre- ceding the date of this Amended Direction of Election be eligible to vote. DIRECTION OF ELECTION By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Rela- tions Act, 49 Stat. 449, and pursuant to Article III, Section 8, of National Labor Relations Board Rules and Regulations-Series 2, it is hereby 15 N. B., No. 94. 823 283029-41-vol. 18-53 824 DECISIONS OF NATIONAL LABOR RELATIONS BOARD DIRECTED that, as part of the investigation authorized by the Board to ascertain representatives for the purposes of collective bargaining with Model Blouse Co., Elias Savada, individually and doing busi- ness under the firm name and style of Model Blouse Co., also doing business under the firm name and style of Savada Brothers, an elec- tion by secret ballot shall be conducted as early as possible but not later than thirty (30) days from the date of this Amended Direction of Election, under the direction and supervision of the Regional Director for the Fourth Region acting ins his matter as agent for the Board and subject to Article III, Section 9, of said Rules and Regulations, among all production employees, whose names appear upon the pay roll of the respondent for his Millville, New Jersey, plant next preceding the date of this Amended Direction of Election, including inspectors and packers, and employees whose names do not appear on such pay roll because they were ill or on vacation or temporarily laid off, and excluding foremen and foreladies and other supervisory employees, janitors, truck drivers, mechanics, office help, and employees in the shipping department, and employees who between such pay-roll date and the date of the election have quit or been discharged for cause, to determine whether they desire to be represented by Federal Labor Union No. 21560, affiliated with the American Federation of Labor, or by Amalgamated Clothing Work- ers of America, affiliated with the Congress of Industrial Organiza- tions, for the purposes of collective bargaining, or by neither.- MR.
