DECISION AND CERTIFICATION OF REPRESENTATIVES STATEMENT OF THE CASE Upon petition duly filed by United Electrical, Radio and Machine `Yorkers of Ameiica, Local 1145, (CIO), herein called the United, alleging that a question affecting commerce had arisen concerning the representation of employees of Minneapolis-Honeywell Regulator Company, herein called the Company, engaged at Minneapolis, Minnesota, in the manufacture of various products used in the de- fense program, the National Labor Relations Board provided for an appropriate hearing upon due notice On June 11, 1942, before a hear- ing was held, the Company, the United, Honeywell Employees' Fed- eral Local No 22849, affiliated with the A F of L , herein called Local 22849, and the Regional Attorney for the Eighteenth Region (Minneapolis, Minnesota), entered into a "STIPULATION FOR CERTIFI- CATION UPON CONSENT ELECTION." Pursuant to the stipulation, an election by secret ballot was con- ducted on June 30, 1942, under the direction and supervision of the Regional Director, among all production and maintenance employees of the Company, including among others, warehouse, stores, shipping, receiving and packing departments, cost department counters and weighers, inspectors other than supervisory inspectors, planning crib employees other than supervisory, employees in the model shop of the 42 N L R B, No 193 1046 MINNEAPOLIS-HONEYWELL REGULATOR COMPANY 1047 engineering department, but excluding all foremen, assistant foremen, other supervisory employees, guards, employees whose duties place them in a confidential relationship to the management, employees of the engineering department except as specified above, all employees in the production office, and desk girls, to determine whether they desired to be represented by the United, or by Local 22849, for the purposes of collective bargaining, or by neither. On July 1, 1942, the Regional Directoi issued and duly served upon the parties an Election Report on the ballot As to the balloting and its results, the Regional Diiector reported as follows Total on eligibility list------------------------------------ 2, 210 Total ballots cast----------------------------------------- 1,852 Total ballots challenged----------------------------------- 26' Total blank ballots---------------------------------------- 0 Total void ballots_________________________________________ 3 Total valid Notes cast-------------------------------------- 1,823 Votes cast foi Local 22849, A F of L----------------------- 802 Votes cast for United Electrical, Radio and Machine Workers of America, Local 1145, CIO----------------------------- 987 Votes cast for neither oiganization------------------------- 34 On July 7, 1942, Local 22849 filed Objections and Protests to the Election On July 14, 1942, Local 22849 withdrew its objections and protests Upon the basis'of the stipulation, the Election Repoit, and the entire record in the case, the Board makes the following FINDINGS OF FACT 1 A question affecting commerce has arisen concerning the repre- sentation of employees of Minneapolis-Honeywell Regulator Com- pany, Minneapolis, Minnesota, within the meaning of Section 9 (c) and Section 2 (6) and (7) of the National Labor Relations Act 2 All production and maintenance employees of the Company, in- cluding among others, warehouse, stoi es, shipping, receiving and pack- ing departmgnts, cost department counters and weighers, inspectors other than supervisory inspectois, planning crib employees other than supervisory, employees in the model shop of the engineering depart- ment, but excluding all foremen, assistant foremen, other supervisory employees, guards, employees whose duties place them in a confiden- tial relationship to the management, employees of the engineering de- partment except as specified above, all employees in the production office, and desk girls, constitute a unit appropriate for the purposes of collective bargaining, within the meaning of Section 9 (b) of the Act 3. United Electrical, Radio and Machine Workers of America, Local 1145, affiliated with the Congress of Industrial Organizations, has been 1048 DECISIONS OF NATIONAL LABOR RELATIONS BOARD designated and selected by a majority of the employees in the above' unit as their representative for the purposes of collective bargaining and is the exclusive representative of all employees in said unit, within the meaning of, Section 9 (a) of the Act. CERTIFICATION OF REPRESENTATIVES By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Relations Act, IT IS HEREBY CERTIFIED that United Electrical, Radio and Machine Workers of America, Local 1145, affiliated with the Congress of In- dustrial Organizations, has been designated and selected by a majority of all production and maintenance workers of Minneapolis-Honeywell Regulator Company, Minneapolis, Minnesota, including among others, warehouse, stores, shipping, receiving and packing departments, cost department counters and weighers, inspectors other than supervisory. inspectors, planning crib employees other than supervisory, employees id the model shop of the engineering department, but excluding all foremen, assistant foremen, other supervisory employees, guards, em- ployees whose duties place them in a confidential relationship to the management, employees of the engineering department except as speci- fied above, all employees in the production office, and desk girls, as their representative for the purposes of collective bar gaining, and that, pursuant to Section 9 (a) of the Act, United 'Electrical, Radio and Machine Workers of America, Local 1145, affiliated with the Congress of Industrial Organizations, is the exclusive representative of all such employees for the purposes of collective bargaining in respect to rates of pay, wages, hours of employment, and other conditions of employ- ment Copy with citationCopy as parenthetical citation
