DECISION AND CERTIFICATION OF REPRESENTATIVES STATEMENT OF THE CASE On May 2, May 5, and July 3, 1941, respectively, Minneapolis Printing Pressmen & Assistants Union No. 20, affiliated with I. P. P. 38 N. L. R. B., No. 130. 652 MINNEAPOLIS-HONEYWELL REGULATOR COMPANY 653 & A. U. of N. A., A. F. of L., herein called the Printing Pressmen, Minneapolis Typographical Union No. 42, A. F. of L., herein called the Typographers, and Minneapolis-Honeywell Regulator Company, herein called the Company, filed petitions with the Regional Director for the Eighteenth Region (Minneapolis, Minnesota), and on August 15, 194f, United Electrical, Radio & Machine Workers of America, Local 1145, herein called the United, filed with the Regional Director an amended petition," each alleging that a question affecting com- merce had arisen concerning the representation of employees of the Company at its plant in Minneapolis, Minnesota, and requesting an investigation and certification of representatives pursuant to Section 9 (c) of the National Labor Relations Act, 49 Stat. 449, herein called the Act.2 The Company is engaged at its Minneapolis plant in the manufacture of various kinds of temperature controlling devices. On August 14, 1941, the National Labor Relations Board, herein called the Board, acting pursuant to Section 9 (c) of the Act and Article III, Section 3 and Section 10 (c) (2) of National Labor Rela- tions Board Rules and Regulations-Series 2, as amended, consoli- dated the cases, ordered an investigation, and authorized the Regional Director to conduct it and to provide for an appropriate hearing upon due notice. On August 22, 1941, the Company, the United, the Print- ing Pressmen, the Typographers, the Board's Regional Attorney, and two additional labor organizations claiming to represent employees of the Company-viz, Honeywell Employees Federal Local Union No. 22849, affiliated with the A. F. of L., herein called the Federal, and Bookbinders & Bindery Women Local Union No. 12, A. F. of L., herein called the Bookbinders-entered into a Stipulation for Cer- tification Upon Consent Election. Pursuant to the stipulation, sepa- rate elections by secret ballot were conducted on September 11, 1941, under the direction and supervision of the Regional Director for the Eighteenth Region among the employees in the following units : (a) Among the production and maintenance employees of the Com- pany, employees of the warehouses, stores, shipping and receiving departments, cost department counters and weighers, watchmen, inspectors other than supervisory inspectors, employees in the plan- ning cribs other than supervisory employees, employees in the model shop of the engineering department, and excluding all foremen, assistant foremen, other supervisory employees, guards, employees whose work places them in a confidential relation to management, employees of the general office, all employees of the engineering department, except as specified above, all employees in the production I A petition had been filed by the United on July 8, 1941 2 The Typographers subsequently requested leave to withdraw its petition, since it claimed to represent only one employee who is part of a unit stipulated by the parties to be appropriate . The request is hereby granted. 654 DECISIONS OF NATIONAL LABOR RELATIONS BOARD office, and all desk girls, to determine whether they desired to be repre- sented by the United, or by the Federal, or by neither; (b) Among the printing pressmen and typographical employees employed in the printing room, to determine whether they desired to be represented by the United, or by the Federal, or by the Printing Pressmen, or by none of these organizations; and (c) Among the bookbinders employed in the printing room, to de- termine whether they desired to be represented by the United, or by the Federal, or by the Bookbinders, or by none of these organizations. On September 15,1941, the Regional Director issued and duly served upon the parties his Election Report. The United on September 29, 1941, also filed objections to the conduct of the elections. None of these objections, except the United's objections to the conduct of the elections, apply to or affect the elections conducted among the printing pressmen and typographi- cal employees and among the bookbinders. On January 9, 1942, the United joined with the Federal, the Printing Pressmen and the Book- binders in a stipulation agreeing to the certification of the collective bargaining representatives of the printing pressmen and typographical employees and of the bookbinders.3 Since the challenged ballots cast by employees in these two units cannot affect the result of either of those elections, we deem it unnecessary to pass upon these challenges. The investigation of the objections affecting the election conducted among the production and maintenance employees is still pending, and we shall therefore make no findings at' this time with respect thereto. There is no reason, however, for any further postponement of our findings and certification with respect to the other units. Upon the basis of the stipulations, the Election Report, and the entire record in the consolidated cases, the Board makes the following: f FINDINGS OF FACT. 1. Questions affecting commerce have arisen concerning the repre- sentation of employees of Minneapolis-Honeywell Regulator Com- pany, Minneapolis, Minnesota, within the meaning of Section 9 (c) and Section 2 (6) and (7) of the Act. 2. The printing pressmen and typographical employees employed in the printing room of the Company's Minneapolis plant constitute a unit appropriate for the purposes of collective bargaining, within the meaning of Section 9 (b) of the Act. 3. The bookbinders employed in the printing room of the Com- pany's Minneapolis plant constitute a unit appropriate for the pur- poses of collective bargaining, within the meaning of Section 9 (b) of the Act. 4. Minneapolis Printing Pressmen & Assistants Union No. 20, Affiliated with I. P. P. & A. U. of N. A., A. F. of L., has been desig- nated and selected by a majority of the printing pressmen and typo- graphical employees employed in the printing room of the Company's 8 By the stipulation , the United in effect waived the applicability of its objections to the elections in these units. 656 DECISIONS OF NATIONAL LABOR RELATIONS BOARD Minneapolis plant as their representative for the purposes of collec- tive bargaining, and is the exclusive representative of all the employees in said unit within the meaning of Section 9 (a) of the Act. 5. Bookbinders & Bindery Women Local Union No. 12, A. F. of L., has been designated and selected by a majority of the bookbinders employed in the printing room of the Company's Minneapolis plant as their representative for the purposes of collective bargaining, and is the exclusive representative of all the employees in said unit within the meaning of Section 9 (a) of the Act. CERTIFICATION OF REPRESENTATIVES By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the 'National Labor Relations Act, IT IS HEREBY CERTIFIED that Minneapolis Printing Pressmen & As- sistants Union No. 20, Affiliated with I. P. P. & A. U. of N. A., A. F. of L., has been designated and selected by a majority of the printing pressmen and typographical employees employed by Minneapolis- Honeywell Regulator Company in the printing room of its Minne- apolis plant as their representative for the purposes of collective bar- gaining, and that, pursuant to the provisions of Section 9 (a) of the Act, Minneapolis Printing Pressmen & Assistants Union No. 20, Af- filiated with I. P. P. & A. U. of N. A., A. F. of L., is the exclusive representative of all such employees for the purposes of collective bargaining with respect to rates of pay, wages, hours of employment, and other conditions of employment. AND IT IS HEREBY FURTHER CERTIFIED that Bookbinders & Bindery Women Local Union No. 12, A. F. of L., has been designated and se- lected by a majority of the bookbinders employed by Minneapolis- Honeywell Regulator Company in the printing room of its Minneapolis plant as their representative for the purposes of collective bargaining, and that, pursuant to the provisions of Section 9 (a) of the Act, Book- binders & Bindery Women Local Union No. 12, A. F. of L., is the ex- clusive representative of all such employees for the purposes of col- lective bargaining with respect to rates of pay, wages, hours of employment, and other conditions of employment.
