The election was conducted pursuant to a Stipulated Election Agreement. The tally of ballots shows 14 ballots cast for and 12 ballots cast against the Petitioner, with 5 challenged ballots, a sufficient number to affect the results. No exceptions have been filed to the Hearing Officer’s report within the time provided. Accordingly, the Board adopts the Hearing Officer’s findings and recommendations. DIRECTION IT IS DIRECTED that the Regional Director for Region 13 shall, within 14 days of this direction, open and count the ballots of William Mansfield, Carl Fleming, Josh Johannpeter, and thereafter prepare and serve on the parties a revised tally of ballots. If the updated tally of ballots shows that the Petitioner has not received a majority of votes in favor of representation, the election held on April 25, 2014 must be set aside, and a second election shall be held.1 Dated, Washington, D.C., August 21, 2014.
