I. O. Case No. 2-R-4974 SUPPLEMENTAL DECISION AND DIRECTION December 19 , 1944 On November 29, 1944, pursuant to the Decision and Direction of Elections issued by the Board herein on October 30, 1944,1 elections by secret ballot were conducted under the direction and supervision of the Regional Director for the Second Region (New York City). Upon the conclusion of the elections, Tallies of Ballots were furnished the parties in accordance with the Rules and Regulations of the Board. No objections to the conduct of the elections were filed by any of the parties within the time provided therefor. The Tally shows that in the production and maintenance unit there were approximately 132 eligible voters, of whom 104 cast valid votes, 61 of which were for the Independent, and 43 for the CIO. Eighteen ballots were challenged. On December 9, 1944, the Regional Director, acting pursuant to Article III, Section 10, of National Labor Relations Board Rules and Regulations-Series 3, as amended, issued and duly served upon the parties a Report on Challenges. No exceptions were filed to said Report by any of the parties within the time provided therefor. We have considered the Report on Challenges and find that Henry Lee Watkins, Joseph England, Arthur Reiman, Robert Stephens, George Forman, Myron Aslanian, Thomas Sweeney, John, Kaspar, Robert Quick, Jean Daneri, John Markofski, William Burke, Henry Mulhol- land, Peter Grompone, Ferdinand Reiman, Herman Deichele, Bess Levy, and Margaret Lanigan are included within the production and maintenance unit found appropriate by the Board in its Decision and Direction of Elections and consequently are eligible to vote in the election. In accord with the recommendations of the Trial Examiner, we shall direct that the ballots of the aforesaid employees be opened and counted. 1 58 N . L R. B. 1568. 59 N. L. R. B., No. 208. 1169 1170 DECISIONS OF NATIONAL LABOR RELATIONS BOARD DIRECTION By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Relations Act, and pursuant to Article III, Sections 9 and 10, of National Labor Re- lations Board Rules and Regulations-Series 3, as amended, it is hereby DIRECTED that, as part of the investigation to ascertain representa- tives for, the purposes of collective bargaining with Mallinckrodt Chemical Works, Jersey City, New Jersey, the Regional Director for the Second Region, shall, pursuant to said Rules and Regulations, within ten (10) days from the date of this Direction, open and count the challenged ballots of Henry Lee Watkins, Joseph England, Arthur Reiman, Robert Stephens, George Forman, Myron Aslanian, Thomas Sweeney, John Kaspar, Robert Quick, Jean Daneri, John Markofski, William Burke, Henry Mulholland, Peter Grompone, Ferdinand Reiman, Herman Deichele, Bess Levy, and Margaret Lanigan, and shall thereafter prepare and cause to be served upon the parties a Supplemental Tally of Ballots for the production and maintenance unit including therein the count of said challenged ballots.
