Apr. 16, 2014) Copy Citation 1 Macomb and McDonough, IL UNITED STATES OF AMERICA BEFORE THE NATIONAL LABOR RELATIONS BOARD MACOMB/MCDONOUGH COUNTY EMERGENCY DISPATCH CENTER Employer and Case 25-WH-110998 ILLINOIS FRATERNAL ORDER OF POLICE LABOR COUNCIL Petitioner CERTIFICATION OF REPRESENTATIVE AS BONA FIDE UNDER SECTION 7(B) OF THE FAIR LABOR STANDARDS ACT OF 1938 On August 12, 2013, Illinois Fraternal Order of Police Labor Council (Petitioner) filed with the Regional Director for Region 25 of the National Labor Relations Board1 a request for certification of representative as bona fide under Section 7(b) of the Fair Labor Standards Act of 1938 (FLSA), 29 U.S.C. § 207(b). On August 22, 2013, the Regional Director served on the parties a Notice to Show Cause why the Board should not grant the request. No response was filed. As the Region’s investigation revealed that the Petitioner is the recognized collective- bargaining representative of the unit employees, the Regional Director recommended to the Board that the requested certification be issued.2 1 The petition was received at Subregion 33 by the Officer-in-Charge, who acted on behalf of the Regional Director for Region 25 in this proceeding. 2 The record indicates that the Employer is a public sector employer and that the Employer and the Petitioner are parties to a collective-bargaining agreement valid by its terms from December 1, 2010 through November 30, 2013, covering the bargaining unit employees’ wages, hours, and other terms and conditions of employment. 2 No party having shown cause why the requested certification should not be issued, the National Labor Relations Board hereby certifies that Illinois Fraternal Order of Police Labor Council is a bona fide representative, for purposes of Section 7(b) of the FLSA, of the employees of Macomb, Illinois in the following unit:3 All full-time Telecommunicators employed by the Macomb/McDonough County Emergency Dispatch Center, but excluding the Director and Assistant Director of the Communications Center; all part-time and temporary Employees; and all supervisors, confidential and managerial Employees as defined by the Illinois Public Labor Relations Act.
