The election was conducted pursuant to a Stipulated Election Agreement. The tally of ballots shows 47 ballots cast for the Petitioner, 22 ballots cast for the Intervenor,1 and 1 ballot cast against the participating labor organizations. There were 4 challenged ballots, an insufficient number to affect the results. No exceptions have been filed to the hearing officer's report within the time provided. Accordingly, the Board adopts the hearing officer's findings and recommendations, and finds that a certification of representative should be issued. 1 SEIU Healthcare Michigan 2 CERTIFICATION OF REPRESENTATIVE IT IS CERTIFIED that a majority of the valid ballots have been cast for National Union of Healthcare Workers and that it is the exclusive collective-bargaining representative of the employees in the following appropriate unit: All full-time and regular part-time CNAs, activities assistants, assistant cooks, cooks, dietary assistants, housekeeping assistants, laundry assistants, maintenance workers, medical records clerks, rehabilitation nursing assistants, schedulers and hydration monitors/CNAs employed by the Employer at its facility located at 3161 Davenport Avenue, Saginaw, Michigan; but excluding all office clerical employees, technical employees, professional employees, licensed practical nurses, registered nurses, confidential employees, agency personnel, CNA contingent pool employees, contingent employees, guards and supervisors as defined in the Act.
