Opinion by Hairston, Administrative Trademark Judge: The Board, in a decision issued August 29, 2002, sustained the opposition under Section 2(d) of the Trademark Act. It has since come to the Board’s attention that on July 24, 2002 applicant filed an abandonment of the involved application with opposer’s consent. As the result of an inadvertence, the abandonment was not associated with the file of the case prior to issuance of the Board’s decision.
